Our client held a headlease of several floors and had sub-let all the floors on a number of underleases, some of which included Schedules of Condition, limiting the undertenants liability to repair and reinstate. The superior landlord’s surveyor served a Schedule of Dilapidations, the relevant parts of which were served on the undertenants. Some of the undertenants renewed their leases. We successfully negotiated settlements with all parties with our client being able to recover much of the superior landlords claim, with some residual liability due to the Schedule of Condition and reinstatement requirements exceeding those of their sub-undertenants.
